MEDICAL SERVICE BROKERAGE AGREEMENT
1. PARTIES
The Medical Service Brokerage Agreement is executed on the date of signature by and between ISTC Urology Clinic and the undersigned client. By the agreement, the client hereby accepts, declares, and undertakes that he/she understands these rules and will comply with them.
ISTC Urology Clinic has the right to amend this agreement at its discretion.
2. DEFINITIONS
Service Provider:
About the real and/or legal persons who provide medical services such as doctors, hospitals, accommodation, and transportation to the patient. As such, the Service Provider is not an ISTC Urology Clinic but instead is applied to the real and/or legal persons from whom the client receives direct service.
Client / Patient: Person in contact with ISTC Urology Clinic to receive health care treatment and services in Turkey and is party to the agreement.
Hospital: The health facility directed and controlled by the Service Providers to the patient.
Hotel: The accommodation facility provided within the scope of the agreement to which the patient has agreed.
Transportation: All necessary transportation services (airport transfer, inner-city transfer, hotel, and clinic) organized by the service provider for the patient within the scope of this agreement.
3. SUBJECT OF THE AGREEMENT
3.1 The agreement regulates medical tourism in Turkey which ISTC Urology Clinic serves as an intermediary party by the requests and concerns of the patient including the arrangement of all services necessary in this context such as medical attendants, hospital, accommodation, travel, and transportation; price and payment basis of these services and the rights and obligations of the parties.
For the avoidance of doubt, it should be noted that ISTC Urology Clinic is not a service provider, but an institution that serves as an intermediary between service providers to provide medical treatment.
3.2 By the agreement, the patient accepts, declares, and undertakes that he/she has been provided preliminary information regarding the services provided in the scope of medical tourism, which will be arranged by the intermediary institution ISTC Urology Clinic in compliance with the agreement in question.
3.3 The patient acknowledges that the service provided by ISTC Urology Clinic as an intermediary service and agrees and undertakes that any potential dispute that occurs under hospital arrangements, medical attendance, transfer arrangements, and accommodation is directed to the appropriate service provider
3.4 Within the scope of the agreement, the patient declares and undertakes that the patient gave his/her accurate personal identity and contact information as well as complies with the necessary health and travel requirements to receive service.
The patient is obliged to sign the patient consent form for the health service he/she will receive, without the use of any pseudonym and by writing his/her full and correct name and surname in compliance with the official records. In the event of missing or erroneous information, ISTC Urology Clinic does not fall under obligation or liability
3.5 By the information and details provided by ISTC Urology Clinic, in cases where the patient is late or absent to either clinical examinations, airport pick-up/drop-off, operation date, or any scheduled arrangement thereunder, all additional costs will be covered by the patient.
4. AGREEMENT PRICE AND METHOD OF PAYMENT
4.1 ISTC does not require prepayment for costs and services provided. Payment in the full amount is realized in cash upon the scheduled treatment date.
In cases in which the patient decides to pre-book treatment, a non-refundable fee of €500 is required as a deposit to set the necessary arrangements with service providers i.e. hospital, hotel, and transportation which is later subtracted from the remaining treatment costs.
The deposit is non-refundable whether under termination of health services by the patient or other unforeseen circumstances to which ISTC Urology Clinic is not liable.
4.2. Balance payment concerning all arrangements subject to intermediary service is payable to ISTC Urology Clinic until the day of operation. In case the Client makes the complete payment subject to this contract, the payment must be approved by ISTC Clinic’s Finance Department 15 Days before the date of operation.
Payments by card or bank transfer will not exceed 20% of the total costs of treatment and services.
4.3. Upon the reservation with a deposit, no refund is granted to the patient if he or she refrains from providing signed consent or fails to fulfill compliance obligations as detailed in the agreement form.
5. PAYMENTS & DEPOSITS
5.1. ISTC Urology Clinic processes all payments in cash.
5.2. ISTC Urology Clinic provides the additional option of split payment with up to 20% of the total operation cost processed via a third-party payment provider.
5.3. In cases of deposit, to secure a booking or promotional offer, ISTC Urology Clinic requires patients to provide a 10% down payment of the total procedure cost with the remainder deducted on the day of operation.
5.4. All transactions with ISTC Urology Clinic are held in are held in a non-interest-bearing trust account. Before the day of operation, ISTC Urology Clinic will communicate and charge the respective deposit amount to the patient and retain said amount until (a) the patient cancels the treatment, (b) the service provider requests the deposit from ISTC Clinic
5.5. Deposits are non-refundable. In case of a refund, up to 50% is applicable under the following conditions:
(a) the physician determines that the patient is not eligible for the treatment
(b) the physician determines that the patient is not eligible for travel
(c) natural catastrophes such as earthquakes wars or
(d) In case of death (automatic cancellation).
5.6. If the patient fails to cancel the appointment and the reason does not all under any of the aforementioned cases stipulated above, none of the cancellation policies apply and ISTC Urology Clinic will charge a cancellation fee from the respective deposit in full made by the patient.
5.7. The following cancellation clauses should apply if the patient decides to cancel:
(i) The patient may cancel the treatment at the latest 14 days before the scheduled appointment. (ii) cancellation of up to 14 days prior to the day of treatment allows the patient up to 50% return of the deposit.
(iii) a cancellation within 7 days before the day of treatment or should the patient not be present, a cancellation fee of the full deposit amount is applied.
(iv) The patient may cancel treatment free of charge via proof if ineligibility provided by a local physician certificate.
(v) The patient may reschedule the treatment date for an extra fee of €150
